In his 20 years of practice, Brian Webber has represented clients in a wide variety of industries, and has done so in many different roles. Whether called upon to litigate a case once a dispute has arisen and litigation or other formal dispute resolution measures are necessary, or asked to get involved early on in the process in an effort to foresee and eliminate risks and potential pitfalls, Brian has helped many clients through the stressful process of a lawsuit as well as the complex modern business and regulatory environment that has to be navigated to succeed. Drafting, interpreting, enforcing, and disputing contracts are critical aspects of running a successful business, and Brian has experience with the various aspects of contract law.
Brian has spent a significant portion of his career working for complex entities in the healthcare, insurance, securities, banking, and real estate worlds, as well as many other areas. Thus, he understands the demands placed on the employers and officers and directors of organizations, and the need pursue to cost-effective and timely solutions to real-world problems. Forming, operating, financing, managing, and governing a business of any size requires effective guidance and advice. Growing a business as well as ultimately selling or winding one down similarly require legal direction, and Brian takes great pride in helping each client find the best ways to achieve their desired goals.
Over the past 20 years of practice, Brian has represented both plaintiffs and defendants in a wide variety of civil litigation, He has successfully tried a significant number of cases to a jury, and has argued before both the Utah Supreme Court and the U.S. Tenth Circuit Court of Appeals. Brian is very proud to represent a wide range of health care providers in medical malpractice cases before DOPL and in State and Federal Courts when claims of negligence are brought against them. Brian also litigates complex commercial litigation, breach of contract, real estate, business disputes, product liability, and many other distinct areas of emphasis in both state and federal courts.
Brian has also arbitrated (usually binding, and often required by contract) and mediated (usually non-binding, and usually voluntary) a great many cases in several diverse areas of law. In a world where lawsuits can be very expensive and take many years to be resolved, alternative dispute resolution, such as arbitration and mediation, are often very desirable methods to resolve problems, and Brian will not hesitate to recommend and pursue either or both if they will save the client time and money and still provide a fair result. Whether these alterative dispute resolution avenues are desirable must be determined on a case-by-case basis, but if your dispute lends itself to one of these methods instead of the typically more costly and protracted litigation all the way to trial, and possibly an appeal, Brian will advise you on those issues so that you can make an informed decision on how to direct your case.
Brian received a Bachelors degree in finance, and has maintained an interest in real estate, finance, banking, and related areas ever since then. He enjoys navigating the ever-changing landscape in these complex arenas. Whether helping a client plan for the future, manage growth opportunities, keep ahead of the legal and regulatory requirements, or prosecute or defend a claim or lawsuit, Brian is engaged in the process and takes great pride in helping individuals and organizations succeed, and is very responsive to the real-time needs that his clients face each day
